Terms of use

The agreement between you and MarketSafe. We’ve kept it in plain language: what you can expect from us, and what we expect from every member.

1. About these terms

These terms are an agreement between you and MarketSafe (Pty) Ltd (registration number 2022/345330/07), which runs MarketSafe. By creating an account or using MarketSafe, you agree to them.

Our Posting rules and Privacy policy form part of these terms. Please read them too.

2. Who can use MarketSafe

  • You must be 18 or older.
  • You may have only one account, and it must be in your own name.
  • You can’t join if we’ve closed an account of yours before for breaking these terms.

3. Your account and the ID check

Before you can list, message or report, you must confirm your cellphone number and email address and pass our ID check. The details you give us must be true and your own.

Keep your password to yourself. You’re responsible for what happens on your account, so tell us straight away if you think someone else has used it. We can refuse or remove a verification if we find that details were false.

4. Deals are between members

MarketSafe is a place to find each other and chat safely. When you buy or sell, the deal is between you and the other member. MarketSafe isn’t the seller, doesn’t own or inspect the items, and isn’t a party to the sale.

We check that members are who they say they are, but we can’t promise that an item is as described, that a member will finish a deal, or that every member will behave honestly. Check the item before you pay, and follow our safety advice.

5. Payments

MarketSafe doesn’t take, hold or pass on payments. You pay each other directly at hand-over, so we can’t refund you or reverse a payment. If we add “Pay safely” later, separate terms will apply to it.

6. Listings

  • Your listings must follow our Posting rules and describe the item honestly.
  • You must own the item and be allowed to sell it.
  • Contact details in a listing are hidden. Some listings are checked by a person before they go live.
  • We can hold, hide or remove any listing that breaks these terms or the law, or that puts members at risk.

7. Your photos, videos and words

You keep the rights to what you post. By posting it, you allow MarketSafe to store, copy, resize and show it on MarketSafe, and in links that you or others share, so that we can run the service. You must own what you post, or have permission to use it, and it mustn’t show other people without their agreement.

8. How you must behave

We have zero tolerance for abusive members and objectionable content. You must not:

  • scam, or try to scam, anyone;
  • lie about who you are or about what you’re selling;
  • harass, threaten, abuse or discriminate against anyone;
  • post content that is offensive, hateful, sexual, violent or illegal;
  • share contact details, or push people to chat or pay outside MarketSafe;
  • open more than one account, or use someone else’s;
  • try to get around our safety checks, copy MarketSafe’s content in bulk, send spam, or interfere with the service.

9. Ratings and reviews

Where MarketSafe lets members rate each other after a deal, reviews must be honest and about that deal. We can remove reviews that are fake, abusive or break these terms.

10. Reports, removals and suspensions

Members can report listings and other members, and block members they don’t want to hear from. We act on reports as explained on our Reports & complaints page. If you break these terms or the law, or put other members at risk, we can remove your content and limit, suspend or close your account. A person makes these decisions, and you can ask us to look at a decision again.

11. Free during the beta

MarketSafe is free to use during the beta. If we introduce fees, we’ll tell you before they apply. The beta is a test version: features may change, and things may not always work as they should.

12. Our responsibility

We work to keep MarketSafe safe and available, but we can’t promise it will always work without interruptions or errors. As far as the law allows, MarketSafe isn’t responsible for loss or damage that comes from deals between members, from the items themselves, or from what members say or do.

Nothing in these terms takes away rights you have under South African law that can’t be limited, including under the Consumer Protection Act where it applies.

13. Closing your account

You can ask us to close your account at any time by contacting us. We can close accounts that break these terms. When an account closes, we keep some information as our Privacy policy explains.

14. Changes to these terms

We may update these terms. The date at the top shows the latest version, and we’ll tell you about important changes before they take effect. If you keep using MarketSafe after that, the new terms apply.

15. South African law

These terms are governed by the law of the Republic of South Africa, and South African courts deal with any dispute about them. Our company details are on the contact page.
